AUTOMATCH, LLC, a New Jersey limited liability company doing business as Invention Solar, with an address at 759 Bloomfield Ave, Suite 403, West Caldwell, New Jersey 07006 (“Invention Solar,” “we,” “us,” or “our”), respects the privacy of individuals who interact with our business. This Privacy Policy explains how we collect, use, disclose, retain, and otherwise handle personal information in connection with the website located at inventionsolar.com (the “Website”), the INVENTIONX online platform located at app.inventionsolar.com (the “Platform”), and the related online features, communications, marketing activities, and services to which this Privacy Policy applies.

This Privacy Policy applies to personal information we handle when you visit or interact with the Website, create or use an account on the Platform, communicate with us, request or purchase services, create or administer a campaign, or otherwise interact with INVENTION SOLAR in circumstances covered by this Privacy Policy. The information we collect and the manner in which we use it may vary depending on the nature of your interaction with INVENTION SOLAR and the features or services you use.

Certain services offered by INVENTION SOLAR involve marketing data, leads, live transfers, appointments, and related campaign services that may be governed by a separate Agreement for the Purchase of Marketing Data and Lead Services, an applicable Order Form, or other written terms between INVENTION SOLAR and a customer. This Privacy Policy describes INVENTION SOLAR’s privacy practices and does not replace contractual obligations concerning the receipt, use, or handling of leads, marketing data, or other information under those agreements. Your access to and use of the Website and Platform are also subject to the applicable INVENTION SOLAR Terms of Service.

 

  1. SCOPE AND APPLICABILITY
  • Scope of This Privacy Policy. This Privacy Policy applies to personal information that INVENTION SOLAR collects or otherwise handles in connection with the Website, Platform, customer accounts, inquiries, transactions, communications, and other interactions with individuals to which this Privacy Policy is made available or expressly applies. It describes INVENTION SOLAR’s practices concerning personal information in its possession or under its control, subject to any additional terms or legal requirements applicable to a particular relationship or service.
  • Website and INVENTIONXPlatform. Personal information may be collected when an individual registers for or uses an Account, interacts with Platform functionality, creates or administers a Campaign, communicates with INVENTION SOLAR, or otherwise interacts with features of the Website or Platform. The particular information involved will depend on the nature of the individual’s interaction and the features or Services used.
  • Business and Customer Information. Because INVENTION SOLAR primarily provides services in a business and commercial context, personal information covered by this Privacy Policy may include information relating to customers, prospective customers, and individuals who own, work for, represent, or act on behalf of a business or other organization. Where an individual uses the Platform or communicates with INVENTION SOLAR on behalf of a customer, this Privacy Policy applies to the personal information INVENTION SOLAR handles concerning that individual in connection with the business relationship.
  • Information Outside the Scope of This Policy. This Privacy Policy does not govern the independent privacy practices of a Customer or other third party after personal information, leads, marketing data, or other information has been lawfully provided or made available to that party as part of the Services. A Customer’s collection, use, disclosure, storage, communication with consumers, or other handling of such information is subject to the Customer’s own legal and contractual obligations, including any obligations arising under an applicable Marketing Agreement. This Privacy Policy also does not govern third-party websites, applications, or services that operate independently of INVENTION SOLAR merely because they may be accessible through or integrated with the Website or Platform.

 

  1. PERSONAL INFORMATION WE COLLECT

The personal information INVENTION SOLAR collects depends on how you interact with us, the Website or Platform features you use, and the Services involved. We may collect the following categories of information where applicable to your interaction with INVENTION SOLAR.

  • Account and Registration Information. When you create, request, or maintain an Account on the Platform, we may collect information such as your name, email address, telephone number, company or business name, username or other Account identifiers, login credentials, and other information submitted as part of the registration or Account administration process.
  • Business and Contact Information. We may collect professional and business-related information that you provide in connection with an inquiry, Customer relationship, or use of the Services, including your name, business contact details, company name, job title or role, business address, and information concerning the organization you own, represent, or work for.
  • Campaign and Service Information. When a Customer requests, creates, submits, or administers a Campaign or communicates with us concerning a Campaign or Service, we may collect information relating to the request, review, approval, or transaction, including Campaign specifications, requested quantities, geographic or targeting criteria, service selections, Campaign status, approval information, Order Form information, and other information provided or generated in connection with the requested Services.
  • Transaction and Billing Information. We may collect information associated with purchases and payments, including billing contact information, billing address, transaction amounts, payment status, invoices, transaction history, and related financial or administrative records. Where payment transactions are processed by a third-party payment provider, payment information may be provided directly to that provider. The particular payment information handled by INVENTION SOLAR will depend on the payment method and processing arrangements used for the transaction.
  • Communications and Customer Support Information. We may collect information contained in communications between you and INVENTION SOLAR, including emails, Platform communications, inquiries, requests, feedback, customer-support communications, and other correspondence, together with information reasonably necessary to respond to or administer those communications.
  • User Content. We may collect information, files, materials, Campaign instructions, communications, and other content that a Customer or authorized user chooses to submit, upload, transmit, or otherwise provide through the Website or Platform. User Content may contain personal information depending on what the Customer or user chooses to provide.
  • Device, Usage, and Technical Information. When you access or interact with the Website or Platform, certain technical and usage information may be collected automatically, such as Internet Protocol address, browser type, device type, operating system, pages or Platform features accessed, dates and times of access, referring or exit information, and information concerning interactions with the Website or Platform. The specific information collected may depend on the technologies and service providers used to operate the Website and Platform.

 

  1. HOW WE COLLECT PERSONAL INFORMATION
  • Information You Provide Directly. We collect personal information that you choose to provide to INVENTION SOLAR, including when you create or maintain an Account, submit an inquiry or request, communicate with us, create or administer a Campaign, purchase or use Services, provide billing or business information, request customer support, submit User Content, or otherwise interact with INVENTION SOLAR. Where you provide personal information concerning another individual, you are responsible for having the authority or other lawful basis necessary to provide that information to us.
  • Information Collected Through the Website and Platform. We may collect certain information automatically when you access or interact with the Website or Platform. This information may be collected through server logs, cookies, and similar technologies used in connection with the operation, security, functionality, and performance of the Website or Platform. The information collected through these technologies will depend on the technologies implemented and the manner in which you interact with the Website or Platform.
  • Information Received from Third Parties. We may receive personal information from third parties in connection with our business operations and the Services, including service providers, technology providers, payment providers, authorized representatives of Customers, and other parties that interact with INVENTION SOLAR on your behalf or in connection with a Customer relationship. The nature of the information received depends on the applicable relationship, transaction, or Service and the information the third party is authorized or permitted to provide.

 

  1. HOW WE USE PERSONAL INFORMATION
  • Providing and Administering Accounts and Services. We may use personal information to establish, administer, maintain, and support Accounts; authenticate users; provide access to the Website and Platform; make Platform functionality available; administer the Customer relationship; and otherwise provide or support Services requested from INVENTION SOLAR.
  • Campaign Administration and Customer Support. We may use personal information to receive, review, process, approve, administer, and support Campaign requests; communicate regarding Campaign specifications or status; prepare or administer applicable Campaign documentation; respond to questions and requests; provide customer support; troubleshoot issues; and maintain records reasonably necessary to administer the applicable Customer relationship.
  • Transactions and Billing. We may use personal information to administer purchases, payments, invoices, billing, and transaction records; communicate regarding amounts due or payment issues; maintain financial and administrative records; and address billing inquiries or disputes. Where a transaction involves a third-party payment provider, information may also be processed in connection with that provider’s payment services as described elsewhere in this Privacy Policy.
  • We may use personal information to communicate with you regarding your Account, Campaigns, transactions, Services, security matters, customer-support requests, changes affecting the Website or Platform, and other matters relating to your relationship with INVENTION SOLAR. Where permitted by applicable law and consistent with any required consent or preferences, we may also use contact information to provide promotional or marketing communications concerning INVENTION SOLAR and its Services.
  • Marketing, Third Party Offers and Business Opportunities. Where permitted by Applicable Law and consistent with any consent or communication preferences required by Applicable Law, we may use personal information relating to customers, prospective customers, prospects, leads, and other individuals to identify, develop, personalize, present, or communicate marketing opportunities, including offers concerning products or services provided by Invention Solar, our affiliates, business partners, advertisers, or other third parties. This may include cross marketing, promotional campaigns, audience selection, matching individuals with potentially relevant products or services, and communicating third-party offers directly to individuals. The manner in which we communicate with an individual, including by email, telephone, or text message, remains subject to Applicable Law and any consent or opt-out rights applicable to that communication method.
  • Security and Fraud Prevention. We may use personal information to authenticate Account activity, maintain the security and integrity of the Website and Platform, identify and investigate suspected unauthorized access, fraud, abuse, or other prohibited activity, enforce applicable terms and policies, and protect INVENTION SOLAR, its Customers, users, systems, and business operations.
  • Platform Development and Improvement. We may use information concerning interactions with the Website and Platform to operate, maintain, troubleshoot, evaluate, develop, and improve their functionality, performance, reliability, and user experience. Where reasonably practicable and appropriate for the relevant purpose, we may use aggregated or de-identified information that does not reasonably identify an individual.
  • Legal and Compliance Purposes. We may use personal information where reasonably necessary to comply with applicable law, regulation, legal process, or governmental requirements; establish, exercise, or defend legal rights or claims; maintain records required for legitimate legal or business purposes; investigate potential violations of our agreements or policies; respond to lawful requests; and protect the rights, property, or safety of INVENTION SOLAR, our Customers, users, or others.

 

  1. COOKIES AND SIMILAR TECHNOLOGIES
  • Cookies and Online Technologies. The Website and Platform may use cookies and similar technologies to support their operation and functionality. These technologies may be used to maintain sessions, remember settings or preferences, support Account functionality, understand interactions with the Website or Platform, identify technical issues, and help maintain the security and reliability of INVENTION SOLAR’s online services. The particular technologies used and information collected may vary depending on the Website or Platform features being accessed.
  • Analytics and Website Usage. INVENTION SOLAR may use analytics and similar technologies to better understand how individuals interact with the Website and Platform, including how pages or features are accessed and used and how the Website or Platform performs. Information obtained through these technologies may be used to evaluate usage, troubleshoot technical issues, maintain functionality, and improve the performance and user experience of the Website and Platform.
  • Cookie Choices. Depending on the technologies used and applicable law, you may be able to manage certain cookies or similar technologies through settings or controls made available on the Website or Platform or through your browser or device settings. Disabling or restricting certain technologies may affect the availability or operation of some Website or Platform features. Where applicable law requires consent before a particular technology is used, INVENTION SOLAR will provide an appropriate mechanism for obtaining or managing that consent.

 

  1. HOW WE DISCLOSE PERSONAL INFORMATION
  • Service Providers. We may disclose personal information to vendors, contractors, and other service providers that perform services for or on behalf of INVENTION SOLAR, such as hosting, infrastructure, communications, customer support, analytics, security, technical support, and other services necessary to operate and support our business, Website, Platform, and Services. These providers may access personal information to the extent reasonably necessary to perform the functions for which they have been engaged.
  • Payment, Document, and Technology Providers. We may disclose or make information available to payment processors, electronic document or signature providers, and technology providers where reasonably necessary to process transactions, prepare, transmit, execute, or maintain contractual records, maintain Platform functionality, provide technical infrastructure, authenticate or secure Accounts, or support other technology used in connection with the Website, Platform, or Services. A provider may also collect information directly from you when you interact with functionality operated by that provider, subject to its own applicable privacy practices.
  • Customer-Authorized Integrations. Where a Customer chooses to connect the Platform with a third-party application, CRM, system, or other integration, we may exchange information with the applicable provider to the extent reasonably necessary to enable or support the integration authorized by the Customer. Information transferred to an independent third-party service may thereafter be handled in accordance with that provider’s own terms and privacy practices.
  • Marketing and Business Partners. Where permitted by Applicable Law, we may disclose or make personal information available to selected marketing partners, advertisers, lead buyers, service providers, business partners, or other third parties in connection with marketing campaigns, promotional opportunities, lead generation, cross marketing, audience matching, or offers for products or services that may be relevant to an individual. Depending on the particular arrangement, a recipient may use the information to provide services to Invention Solar or may process the information for its own permitted business or marketing purposes. Where Applicable Law requires notice, consent, an opportunity to opt out, or another privacy choice before such disclosure or use, we will provide or honor the applicable requirement.
  • Professional Advisers and Legal Disclosures. We may disclose personal information to attorneys, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary in connection with the services they provide to INVENTION SOLAR. We may also disclose personal information where we reasonably believe disclosure is necessary to comply with applicable law, legal process, court order, or lawful governmental request; establish, exercise, or defend legal rights; investigate fraud, security incidents, or unlawful activity; enforce applicable agreements or policies; or protect the rights, property, or safety of INVENTION SOLAR, our Customers, users, or others.
  • Business Transfers. Personal information may be disclosed or transferred in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets or business operations, change of control, or similar corporate transaction involving INVENTION SOLAR. Where required by applicable law, personal information transferred in connection with such a transaction will remain subject to applicable privacy protections.

 

  1. MARKETING AND COMMUNICATION PREFERENCES
  • Email Communications. Invention Solar may send emails relating to Accounts, Campaigns, transactions, Services, customer support, security matters, and other aspects of the customer relationship. Where permitted by Applicable Law, Invention Solar may also send promotional emails concerning its products or Services, third-party products or services, offers, promotions, business opportunities, or other marketing content based on the recipient’s relationship with Invention Solar and any consent or preferences required by Applicable Law.
  • Promotional Text Messages. Where an individual has separately provided any consent required by Applicable Law, Invention Solar may send promotional text messages concerning its products or Services, third-party products or services, offers, promotions, or related business opportunities to the telephone number designated by that individual. Consent to receive promotional text messages is not a condition of purchasing Services. Message and data rates may apply. An individual may withdraw consent or opt out in accordance with the instructions provided in the applicable message and the Terms of Service.
  • Marketing Choices and Opt-Out Rights. You may opt out of promotional emails by using the unsubscribe method included in the applicable communication or by contacting Invention Solar using the information provided in this Privacy Policy. You may opt out of promotional text messages by replying STOP or by using another opt-out method identified in the applicable message. We may retain information reasonably necessary to record and honor an opt-out request. Where Applicable Law provides a separate right to opt out of the sale or sharing of personal information, targeted advertising, or another form of processing, eligible individuals may exercise that right as described in Sections 11 and 12.
  • Transactional and Service Communications. Opting out of promotional communications does not prevent INVENTION SOLAR from sending non-promotional communications reasonably necessary to administer an Account, Campaign, transaction, payment, customer-support request, security matter, legal notice, or other ongoing Customer relationship. Where an Account or contractual relationship remains active, certain service-related communications may be necessary to administer that relationship.

 

  1. CUSTOMER DATA, LEADS AND CAMPAIGN INFORMATION
  • Customer-Provided Information. In connection with an Account, Campaign, or requested Service, a Customer may provide INVENTION SOLAR with information concerning its business, representatives, Campaign requirements, intended service area, targeting criteria, or other information reasonably related to the Services. INVENTION SOLAR may handle such information as necessary to administer the Customer relationship and provide or support the applicable Services, subject to this Privacy Policy and any separate agreement governing the relationship.
  • Campaign-Related Information. INVENTION SOLAR may create, receive, maintain, and process information associated with a Campaign, including Campaign specifications, status information, fulfillment records, communications, and related administrative information. Campaign-related information may be made available through the Platform or otherwise communicated to authorized Customer representatives as reasonably necessary to administer or fulfill the applicable Campaign.
  • Leads, Prospects and Marketing Data. Certain Services and business activities of Invention Solar may involve leads, Marketing Data, live transfers, appointments, prospect information, customer information, or other information relating to prospective or existing consumers or businesses. Subject to Applicable Law, the applicable source of the information, any required consent or privacy choice, and any contractual restrictions applicable to the information, Invention Solar may use such information to provide and administer Services, conduct lead generation and marketing activities, communicate relevant offers, develop or identify marketing opportunities, conduct cross marketing, and present or facilitate offers concerning Invention Solar or third-party products and services. Where information is provided to a Customer as part of a Campaign, the Customer’s rights and responsibilities concerning that information remain subject to the applicable Marketing Agreement, Order Form, and Applicable Law. Nothing in this Privacy Policy expands a Customer’s contractual right to use personal information beyond the rights provided under the agreement governing the applicable Services.
  • Customer Responsibilities. Once a Customer receives or accesses leads, Marketing Data, or other personal information through the Services, the Customer is responsible for its own collection, use, storage, disclosure, communications, and other handling of that information to the extent it acts independently of INVENTION SOLAR. The Customer must comply with the privacy, consumer-protection, marketing, consent, and other requirements applicable to its activities and with any additional obligations established by the Marketing Agreement or other agreement governing the applicable Campaign.
  • Marketing Use and Source Restrictions. Our ability to use or disclose prospect, lead, customer, or other personal information for marketing purposes may depend on how the information was obtained, the notices or consents associated with its collection, contractual restrictions imposed by a data source, and Applicable Law. Nothing in this Privacy Policy is intended to authorize a use or disclosure that is prohibited by Applicable Law or by a binding restriction applicable to the information.

 

  1. DATA RETENTION
  • Retention Criteria. INVENTION SOLAR retains personal information for as long as reasonably necessary for the purposes for which it was collected or otherwise processed, taking into account the nature of the information, the applicable Customer or business relationship, the Services involved, operational requirements, and any legal, regulatory, contractual, accounting, security, or dispute-related obligations that may require continued retention. Different categories of personal information may therefore be retained for different periods.
  • Account, Campaign, and Transaction Records. Information associated with an Account, Campaign, transaction, or Customer relationship may be retained while the applicable Account or relationship remains active and thereafter for a reasonable period where necessary to maintain business and transaction records, administer outstanding obligations, address inquiries or disputes, prevent fraud or misuse, or comply with applicable legal or contractual requirements. Closure of an Account does not necessarily result in immediate deletion of all information associated with that Account.
  • Legal and Business Retention Requirements. INVENTION SOLAR may retain certain information after it is no longer required for the immediate purpose for which it was collected where retention is reasonably necessary to comply with applicable law, preserve financial or transaction records, establish or defend legal claims, enforce agreements, maintain security or fraud-prevention records, honor communication preferences, or satisfy other legitimate recordkeeping requirements. When personal information is no longer reasonably required for an applicable purpose, INVENTION SOLAR may delete, anonymize, or otherwise dispose of it in accordance with its applicable practices and legal obligations.

 

  1. DATA SECURITY
  • Security Measures. INVENTION SOLAR uses reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, acquisition, use, disclosure, alteration, loss, or destruction, taking into account the nature of the information and the systems through which it is processed. These measures may be reviewed and adjusted from time to time as our technology, business operations, and security requirements develop.
  • Limitations of Security. No method of transmitting information over the internet, electronic storage system, or security measure can guarantee complete security. Accordingly, while INVENTION SOLAR takes reasonable measures designed to protect personal information, we cannot guarantee that personal information will always remain secure or that unauthorized access, disclosure, loss, or other security incidents will never occur. You should use appropriate care when providing information electronically and take reasonable steps to protect the confidentiality of your Account credentials and devices.

 

  1. PRIVACY RIGHTS AND CHOICES
  • Access and Correction. Depending on applicable law and the nature of your relationship with INVENTION SOLAR, you may have the right to request access to certain personal information we maintain about you or to request correction of personal information that is inaccurate. Customers and authorized users may also be able to review or update certain Account information through available Platform functionality.
  • Deletion Requests. Where provided by applicable law, you may request deletion of certain personal information maintained by INVENTION SOLAR. A deletion request may be subject to exceptions or limitations, including where retention is reasonably necessary to complete a transaction, administer an existing contractual relationship, comply with applicable law, maintain required business or financial records, protect security or prevent fraud, establish or defend legal claims, honor communication preferences, or otherwise retain information as permitted by law.
  • Communication Choices. You may exercise available choices concerning promotional communications as described in Section 7 of this Privacy Policy. An election not to receive promotional communications does not necessarily prevent INVENTION SOLAR from sending transactional, Account-related, security, legal, or other non-promotional communications reasonably necessary to administer an existing relationship.
  • Other Applicable Privacy Rights. Depending on where you reside and the privacy laws applicable to INVENTION SOLAR, you may have additional rights concerning your personal information. Additional rights that may be available to residents of certain U.S. states are addressed in Section 12 of this Privacy Policy.
  • Submitting and Verifying Requests. Privacy requests may be submitted using the contact information provided in Section 15 of this Privacy Policy. INVENTION SOLAR may request information reasonably necessary to verify the identity and authority of the person making the request before acting on it. Where permitted by applicable law, an authorized agent may submit a request on another individual’s behalf, subject to reasonable verification of the agent’s authority and the identity of the individual concerned.
  • Non-Discrimination. Where applicable law provides a right to exercise a privacy request without discriminatory treatment, INVENTION SOLAR will not unlawfully discriminate against an individual for exercising that right. This provision does not prevent INVENTION SOLAR from making distinctions that are reasonably related to the value or functionality of a Service or otherwise permitted by applicable law.

 

  1. S. STATE PRIVACY DISCLOSURES
  • State Privacy Laws. Residents of certain U.S. states may have additional rights concerning their personal information under applicable state privacy laws. The availability and scope of those rights depend on the law applicable to the individual, whether INVENTION SOLAR is subject to that law, the nature of the personal information involved, and any statutory exceptions or limitations.
  • Additional Privacy Rights. Where required by applicable state privacy law, eligible individuals may have rights in addition to those described in Section 11, which may include the right to confirm whether personal information is being processed, access or obtain a copy of certain personal information, correct inaccuracies, request deletion, obtain certain information in a portable format, and exercise other rights provided by applicable law. INVENTION SOLAR will process qualifying requests in accordance with the requirements and limitations of the law applicable to the request.
  • Sale, Sharing, Targeted Advertising and Third-Party Marketing. Some disclosures or uses of personal information for advertising, lead generation, cross-marketing, third-party offers, or other marketing activities may be considered a “sale,” “sharing,” targeted advertising, or a similar regulated activity under certain U.S. state privacy laws, even where no monetary payment is exchanged for the information. Where Invention Solar engages in an activity subject to such requirements, eligible individuals may have the right to opt out or exercise another privacy choice provided by Applicable Law. Invention Solar will provide and honor any notice, consent mechanism, opt-out method, or other privacy choice required by the law applicable to the particular activity.
  • Appeals and Authorized Agents. Where applicable state law provides a right to appeal a decision concerning a privacy request, INVENTION SOLAR will provide the applicable appeal process in accordance with that law. Where permitted by applicable law, an authorized agent may exercise qualifying privacy rights on behalf of an individual, subject to reasonable verification of the agent’s authority and any verification requirements applicable to the individual.

 

  1. CHILDREN’S PRIVACY
  • Services Intended for Adults. The Website, Platform, Accounts, and Services are intended for adults and business users and are not directed to children. Individuals under the age of eighteen (18) are not permitted to create an Account or use the Platform or Services.
  • Information Concerning Children. INVENTION SOLAR does not knowingly seek to collect personal information online directly from children under the age of thirteen (13). If we become aware that personal information has been collected directly from a child under thirteen in circumstances requiring parental consent under applicable law and such consent has not been obtained, we will take reasonable steps to delete or otherwise address the information as required by applicable law. A parent or legal guardian who believes that a child has provided personal information to INVENTION SOLAR may contact us using the information provided in Section 15 of this Privacy Policy.

 

  1. CHANGES TO THIS PRIVACY POLICY
  • Policy Updates. INVENTION SOLAR may update this Privacy Policy from time to time to reflect changes in our Website, Platform, Services, business practices, technologies, legal requirements, or the manner in which we handle personal information. When we update this Privacy Policy, we will revise the “Last Updated” date displayed at the beginning of the Policy. We encourage you to review the Privacy Policy periodically to remain informed about our privacy practices.
  • Material Changes. If we make a material change to this Privacy Policy or to the manner in which personal information is collected, used, or disclosed, we may provide additional notice through the Website, Platform, email, or another appropriate method, as required by applicable law and appropriate to the nature of the change. Where applicable law requires consent before personal information previously collected may be used or disclosed in a materially different manner, INVENTION SOLAR will obtain such consent before applying the new practice to that information.
